(“Sponsor”) is offering the HOTEL GAVARNI PARIS GIVEAWAY SWEEPSTAKES (“Sweepstakes”). NO PURCHASE NECESSARY TO ENTER OR TO WIN THIS SWEEPSTAKES. PURCHASE OF ANY GOODS OR SERVICES WILL NOT INCREASE THE ODDS OF WINNING. Eligibility. The Sweepstakes is open only to legal residents of the United States who are at least eighteen (18) years of age at the time of entry, and meet the eligibility requirements detailed below. Unless otherwise advised on Sponsor’s website, any other attempt at Internet, mail-in, email, or other mode of entry is void. Sponsor does not assume any responsibility for lost, late, incomplete, stolen, misdirected, or ineligible entries; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/website/use net accessibility or availability, traffic congestion, or unauthorized human intervention. Sweepstakes Period; Drawings. The duration of the Sweepstakes shall be from 12:00 a.m. January 3, 2011 to 11:59:59 p.m. February 14, 2011 (Pacific Time) (the “Sweepstakes Period”). A Sweepstakes winner will be selected by random drawing from all eligible entries received during the Sweepstakes Period. Any questions or disputes will be judged by Sponsor. Odds of Winning. The odds of winning depend upon the total number of eligible entries received during the Sweepstakes Period. Prizes. There will be one (1) grand prize winner of the Sweepstakes. The grand prize winner of the Sweepstakes will receive a four (4) night stay in a Deluxe Room for up to two people at Hotel Gavarni, 5 rue Gavarni, Paris, France 75116. Travel must be completed by January 2012. Advance reservations required, subject to availability, 72-hour advance cancellation policy. Credit card required to hold reservation. New Year's Eve and Day are blackout days. The grand prize does not include airfare, transportation, meals, taxes, tips, and other costs and expenses. Further details about the grand prize can be found on the Sponsor’s website. No substitution of prize permitted, except by Sponsor who reserves the right to substitute a prize of comparable or greater value. The grand prize winner is prohibited from selling the prize, but may transfer the prize by gift to another person. Notification of Winner. Winner will be notified within twentyfour (24) hours of the Sweepstakes drawing via email. The winner will have three (3) calendar days from the date they are notified to claim their prize. Failure to respond within the prescribed three (3) calendar days of notification will result in the disqualification of the winner and the selection of an alternate winner. The prize will be awarded only after the completed Affidavit (as defined in Paragraph 11 below) has been received by Sponsor. Return of any prize notification as undeliverable will result in disqualification and an alternate winner will be selected. In the event the winner declines his or her prize or fails to return the completed Affidavit, except where prohibited by law, Sponsor will select an alternate winner. The reporting and payment of any tax liabilities incurred by the winner as a result of the Sweepstakes are the sole responsibility of the winner. Release. Disclaimer and Limitations of Liability. Sponsor expressly disclaims any responsibility and participants hereby release, and agree to indemnify, defend and hold harmless, Sponsor and its employees, officers, directors, managers, shareholders, members, agents, and its respective parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors and successors from any and all claims and demands arising out of or in connection with any injury or loss to any person or property relating to participation in the Sweepstakes or the delivery and/or subsequent use or misuse of any of the prizes awarded.
